New theory of the case, that Darin, Darlie’s husband, committed the crime, and not an unidentified intruder. Theory is as follows:

Darin’s background

Darin was not honest, his big start in the computer business was from stealing supplies from Cuplex.


The first insurance scam

Darin was using drugs, got into financial difficulties. Darin did an insurance scam, claiming his car was stolen, but actually he just hid it. He eventually admitted to this scam in an affidavit.

The second insurance scam

Darin decided on a new scam, the murder of Darlie and the boys for life insurance money. Darin changed Darlie’s life insurance polices to favour himself. His drug suppliers (crime family?) may have suggested it as means of repaying his debt, and also supplied “date rape” type drugs to be used on his wife. They may have threatened Darin that if he didn’t get the money somehow, he himself would be killed, or others.
Darin staged a black car “casing the joint”. Darin said in his affidavit, he was planning to rob his own home and this car was intended to make it appear someone was scoping out his house. Darin made a point of telling several neighbours about the car. Karen Neal came home from work one afternoon and found that car parked in front of her house. Jovell said Darin was planning to rob his house to collect the insurance money. He asked her to stage a car to make it appear someone was scoping out the house. There can be little doubt that Darin staged the black car.
Darin obtained or already had drugs to drug Darlie on the night of the staged rape/murder. He had an affair with Dana, Darlie’s sister. He may have been drugging Darlie so she would not hear him and Dana carrying on their affair upstairs.

June 6, 1996

On the night of the murders ( 6/6/96 ), Darlie and Darin had a very serious fight. Darin had contracted herpes, she did not have herpes. Darlie confronted Darin about his affair with Dana and that is why Darlie sent Dana home. Darin knew if Darlie left him he would be exposed for everything. He would have been financially crippled for the rest of his life. He resolved to carry out the crime that night.

Darin drugged Darlie, to help with the staging of the crime. He decided to murder Darlie and the boys, to get out of his financial problem and perhaps to start a new life. Darin had been dating Cindy, his now wife when Darlie Kee introduced him to Darlie. He dumped Cindy and never looked back. After Darlie was arrested there appeared to be something going on between Darin and Dana while he was still living at Darlie Kee’s home. After he moved out he got back together with Cindy.

The stabbings

Darin stabbed the boys, and staged a sex attack on Darlie, also slashing her throat, but broke off, either leaving her for dead, or to help with his alibi. He went through the utility into the garage. He changed out of his jeans, into a new pair. The bloody pair were hidden but later discovered concealed in the utility room.

Later he went down the alley-way to dispose of Darlie’s panties. He accidentally dropped the sock that was found later. Darin ran back to the house.
Later Darin was seen whispering with Darlie, and must have persuaded her to give him a false alibi ( that she saw him coming down the stairs ). Greg Davis was able to get Darin to admit to him before the trial that Darlie was not at the foot of the stairs when he said he came down, proving that Darlie gave him a false alibi.

Darin Substitutes his own attorney

First Darlie Kee and Darin breached the gag order by going on a radio talk show to talk about her case they were slapped with a breach and Kee hired Mulder to represent both her and Darin. While Mulder was working for them he told Darlie Kee and Darin that the court appointed lawyers working for Darlie were going to implicate Darin in the crime. They had the jeans and other evidence pointed to his guilt. Once Darlie Kee and Darin learned of this they made a deal to give Mulder a $100,000 dollar retainer and he agreed not to implicate Darin in the crime ( see here ). The transcripts are proof he made this deal with them. The court appointed lawyers took legal action and tried to stop Mulder from destroying Darlie’s case telling him if he did not implicate Darin and show the jury all the evidence against him Darlie was going to lose her case and go to death row. They all ignored the warnings including Darlies mother. Mulder went out of his way to make sure he never implicated Darin.

During Darin’s testimony Mulder caught Darin lying about the table falling on Devon. He tried to get Darin to change his testimony – the prosecution naturally didn’t object and Darin refused to tell the truth or change his story. They simply moved on when they could have charged Darin right there for perjury. If you read the transcripts Greg Davis confronts Darin of his lies, pointing out to Darin that his story was not the same as what he had said in August at the hearing. Greg Davis knew Darin planted or lost the sock, he knew about Darin leaving the house, he knew he lied about his alibi, he knew he lied about Damon having no pulse before the police arrived. He knew Darin lied about meeting Waddell outside, he knew about the affair between Darin and Dana and he never disclosed any of this to the jury and neither did Doug Mulder.

They claimed the jeans were lost but the detectives for Pardo still had that evidence and they confronted Darlie about those jeans in 2005. That was when Darlie Kee and Darin wrote their affidavits admitting to the deal they made with Mulder. Darin admitted to the fight with Darlie and he confessed to his plans to rob his house. In 2018 Darin tried to retract that in his interview on “the last defense” claiming Darlie and her lawyers forced him to sign the affidavit, the truth is every thing in those affidavits was the truth.

Trial Aftermath

Subsequently Darin and Darlie Kee, have acted to suppress information about Darin, keeping Darlie isolated. Darlie reacted strongly when she heard about Darin’s hidden bloody jeans being discovered. Attorneys have refused to consider Darin as a suspect, and instead have pursued a theory that there was an unknown intruder, which is bound to fail.

Darin has repeatedly changed his story, and even tried to withdraw his sworn affidavit concerning the car insurance scam. He was able to appear in the “Last Defence Documentary” claiming he went out looking for the black car that he had staged.
Extreme measures and threats have been made by Darin or associates to suppress the truth coming out. Hubpages opened an investigation and contacted homeland security after the threats were posted on the Hubpages article. TJ ( who contacted me ) says: “I am afraid of Darin, that is why I deleted my friends on facebook. I closed the groups I started and removed all the members. Between him and Darlie they have made some very serious threats to me.”

More details

Jimmy Patterson was a narcotics detective for years. He may have been the source of the drugs and why he went to such great lengths to lie and cover for Darin. Char Patterson his son and Darin had access to drugs.

Officer Waddell and Walling believed Darin did it almost immediately. They knew it was Darin who planted the sock. The second Patterson walked onto that scene. Darin was dropped as a suspect and they immediately targeted Darlie and only Darlie.

Walling said Darin came back into the house just as Walling was coming down the hall. Walling said Darin was just standing there in the living room but he was red faced and out of breath as though he had been running. Darlie is heard telling Darin to hurry 15 seconds into the 911 call. If he was with Devon as claimed she would not be telling him to hurry. Darlie thought Darin was still upstairs, but in reality he had left the house.

When they took Darin’s jeans at the hospital they had a fresh rip in them. Darin told Patterson he ripped them while fixing the fence. Every officer on the scene testified that gate was not fixed. Darin ripped those jeans while jumping the fence to go down the alley. I know he was capable of doing that because he had done it at Pardo’s house and his fence was much higher. When Pardo did not answer the door to Darin, Darin jumped the fence and went to his door anyway. Darin was very physically strong, he admitted that in court.

At 2:34 Darin left the house, he told Greg Davis that is when he went to Karen Neals to get help for Darlie and Damon. Darin did not go over to Karen Neals until 2:40 after Damon was removed from the house. He was not sent there to bring her back to help. Waddell sent him over there to get him out of the house. Darin gave Davis at least 4 different lies and excuses as to why he never tried to help Damon.

Darin sat outside for over 3 hours, he desperately tried to get back into that house. Then he lied in his statement claiming he pushed past police and got back in. Every officer testified Darin never got back in. Darin sat in that front yard watching and listening to everything the police were doing and talking about. Waddell said that is when he was convinced that the parents killed the boys. Walling felt the same way.

More details / suspicious circumstances

Three days after the murders, Chad Patterson had his car crushed in a scrap yard. Chad’s girl friend ended up dead in the same lake close to where Darin stored his boat. She was fully clothed and was wearing her jewellery. It was claimed to be a water skiing accident.

TJ: “I don’t know if you ever watched that Leeza show she did on Darlie. Darin, Kee and Dana were all sitting there snuggled together. Darlie Kee actually looked into the camera and bare face lied about Darin not being the one to run out and meet Waddell. She actually accused Waddell of being so negligent he allowed the intruder to get away. Darin then claimed that he ran out after the intruder and went to Karen Neals to get her help? Darin didn’t go to the Neals until after the medics and officers were in the home. Damon was already removed when he was still there and Darlie was being taken to the porch. That never happened until 2.40 six minutes after Darin claimed he went to Karen’s for help.”
